Haz-mat Drivers Are Subject To New Qualifications
The Transportation Security Administration of the Department of Homeland Security is in the final phase of adopting new qualifications for those companies applying for a hazardous materials endorsement for a Commercial Drivers License (CDL). Announced in Docket Number TSA2003-14610: Amendment No. 1572-1, the new regulation would prohibit an individual from holding a hazardous materials CDL if he or she: 1) is an unlawful permanent resident alien or has renounced their US citizenship, 2) is wanted or under indictment for certain felonies, 3) has a conviction in civilian or military court for certain felonies, 4) has been adjudicated as a mental defective or been committed to a mental institution, or 5) is considered to pose a security threat based on a review of various databases. In addition, CDL‘s will not be issued to one who tests positive for a controlled substance or one who has adulterated or substituted a test specimen. There also are considerations for military discharge, but not all military discharges pose security risks.
