The U.S. Environmental Protection Agency (EPA) is urging small businesses, schools, and other facilities to take a closer look at how they manage hazardous waste to avoid violations that can result in costly penalties.
Over the past several years, EPA Region 2 — which includes New York, New Jersey, Puerto Rico, and the U.S. Virgin Islands — has identified a growing number of facilities that are unknowingly out of compliance with federal hazardous waste rules. A frequent misstep: shipping hazardous waste without first obtaining an EPA identification number.
What they’re saying: “These violations often come from confusion, not bad intentions,” said EPA Regional Administrator Michael Martucci. “We want businesses to clearly understand their responsibilities, protect health and the environment, and steer clear of expensive mistakes.”
- To help, the EPA has implemented Expedited Settlement Agreements that allow noncompliant facilities to quickly correct issues and return to compliance with reduced penalties.
Are You Generating More Hazardous Waste Than You Realize?
Facilities that produce more than 100 kilograms (≈220 pounds) of hazardous waste in a month must notify the EPA and follow more stringent storage, handling, and shipping rules. Common sources of hazardous waste include:
- Used paint, thinners, or solvents
- Expired lab and cleaning chemicals
- Sterilants and disinfectants
- Waste from auto shops, school art programs, dental clinics, and medical offices

- “If you run a small business, you may be generating more hazardous waste than you think,” Martucci added. “The rules are there to protect your workers and your community.”

- Apply for an EPA ID number using Form 8700-12
- Follow generator category rules for labeling, storage, and disposal
